Q: Can I complete the separation transfer if I don’t have consent orders or a BFA?

Yes, you can, however there are a couple of important considerations.

  • It may compromise your legal position
  • It may cause you to pay unnecessary stamp duty

  • We will obtain property orders from the Family Court of WA: The easiest way of affecting a separation transfer is to have in place property orders from the Family Court of WA or a Binding Financial Agreement. This effectively becomes the contract that allows the transaction to be assessed as “nominal” duty by the Office of State Revenue. Without these orders the transaction will attract stamp duty at the general rate of duty In addition, property orders will guide the bank involved with the refinance as to the amount of the loan required.   • We’ll provide your bank or finance broker with a copy of the orders
  • Once we have the orders we’ll get the ball rolling with an initial phone interview with both parties to the transaction to ensure we understand each person’s unique needs and
    requirements.
  • We will then prepare the Transfer Of Land and other settlement documentation and have all parties sign them.
  • We will liaise with the bank or anyone else who holds an existing mortgage or encumbrance over the property, if applicable.
  • We will then have the transaction assessed for duty.
  • Once the settlement takes place we’ll distribute the funds in accordance with the property orders.
  • We will then lodge the required documents with Landgate to ensure the property ownership is recorded in accordance with the orders.
